WASHINGTON—Secretary of Homeland Security Jeh Johnson announced his decision to designate Yemen for Temporary Protected Status (TPS) for 18 months due to the ongoing armed conflict within the country. Yemen is experiencing widespread conflict and a resulting severe humanitarian emergency, and requiring Yemeni nationals in the United States to return to Yemen would pose a serious threat to their personal safety. As a result of Yemen’s designation for TPS, eligible nationals of Yemen residing in the United States may apply for TPS with U.S. Citizenship and Immigration Services (USCIS). The Federal Register notice posted today provides details and procedures for applying for TPS.

The TPS designation for Yemen is effective September 3, 2015, and will be in effect through March 3, 2017. The designation means that, during the designated period, eligible nationals of Yemen (and people without nationality who last habitually resided in Yemen) who are approved for TPS will not be removed from the United States and may receive an Employment Authorization Document (EAD). The 180-day TPS registration period begins today and runs through March 1, 2016.

To be eligible for TPS, applicants must demonstrate that they satisfy all eligibility criteria, including that they have been both “continuously physically present” and “continuously residing” in the United States since September 3, 2015. Applicants also undergo thorough security checks. Individuals with certain criminal records or who pose a threat to national security are not eligible for TPS. The eligibility requirements are fully described in the Federal Register notices and on the TPS Web page at www.uscis.gov/tps.

Applicants may request that USCIS waive any or all TPS-related fees based on inability to pay by filing Form I-912, Request for Fee Waiver, or by submitting a written request. Fee-waiver requests must be accompanied by supporting documentation. USCIS will reject any TPS application that does not include the required filing fee or a properly documented fee-waiver request. All USCIS forms are free. Applicants can download these forms from the USCIS website atwww.uscis.gov/forms or request them by calling USCIS toll-free at 1-800-870-3676.

Applicants seeking information about the status of their individual cases can check My Case Status Online or call the USCIS National Customer Service Center at 1-800-375-5283 (TTY 1-800-767-1833) at no cost.

Due to the outbreak of Ebola virus disease in West Africa, Secretary of Homeland Security Jeh Johnson has announced his decision to designate Liberia, Guinea, and Sierra Leone for Temporary Protected Status (TPS) for 18 months.  As a result, eligible nationals of Liberia, Guinea, and Sierra Leone who are currently residing in the United States may apply for TPS with U.S. Citizenship and Immigration Services (USCIS).

The TPS designations for the three countries are effective Nov. 21, 2014 and will be in effect for 18 months. The designations mean that eligible nationals of Liberia, Guinea, and Sierra Leone (and people without nationality who last habitually resided in one of those three countries) will not be removed from the United States and are authorized to work and obtain an Employment Authorization Document (EAD). The 180-day TPS registration period begins Nov. 21, 2014 and runs through May 20, 2015.

To be eligible for TPS, applicants must demonstrate that they satisfy all eligibility criteria, including that they have been “continuously residing” in the United States since Nov. 20, 2014 and “continuously physically present in” the United States since Nov. 21, 2014.  Applicants also undergo thorough security checks.  Individuals with certain criminal records or who pose a threat to national security are not eligible for TPS. 

Liberians currently covered under the two-year extension of Deferred Enforced Departure (DED) based on President Obama’s Sept. 26, 2014 memorandum may apply for TPS. If they do not apply for TPS within the initial 180-day registration period, they risk being ineligible for TPS because they will have missed the initial registration period. Liberians covered by DED who already possess or have applied for an EAD do not need to also apply for one related to this TPS designation. However, such individuals who are granted TPS may request a TPS-related EAD at a later date as long as the TPS designation for Liberia remains in effect.

Ask an immigration attorney about the most frustrating aspect of their practice today, and most will tell you that they spend an inordinate amount of time explaining basic reasoning and logic skills to US immigration officers set to deny approvable cases – cases where the only dispute is what the record logically reflects, not an actual insufficiency of the record itself.

Why is this? Are the adjudicating immigration officers at DHS and DOS deliberately harassing petitioners and applicants? Is there some anti-immigrant conspiracy or cabal? Unlikely, but what then explains this phenomena?

Social science has the answer and you should use it to your advantage when appealing an illogical denial or notice of intent to revoke.

Let’s take a closer look at the problem…

Whether it’s a family case suspected of a fraud in Ghana, or an H-1B petition for a growing IT startup, petitioners are being suspected of fraud at alarming rates.

Most denials are based upon a failure to provide “sufficient evidence” to establish eligibility for the benefit sought. However in many, if not all of these cases, the officer likely believes there to be an element of potential fraud that they are valiantly battling back against.

This is because every officer is trained to suspect fraud around every corner and success is measured not in cases approved or growth of the economy, but in levels of potential fraud detected and prevented.

Walk through a service center and what do you see? Take a look at embassy cubicles and what do you find? I will tell you what we find; we find “fraud” literally wallpapering the environment.

Service Centers and Embassies are covered with newspaper clippings, training materials, and bulletins detailing high levels of immigration fraud, warning staff to be hyper-vigilant for fraud.

The US Embassy is Accra, Ghana is an excellent case in point. The Inspector General (OIG) Latest Report[2] found: “The staff capably and courteously handles a heavy workload in a challenging, high-fraud environment.” The report then notes, “Fraud in immigrant and NIV applications is widespread. Consular officers are attentive to the potential for fraud and malfeasance. The recent investigation and subsequent dismissal of a long-time LE staff employee and some local guards has heightened this awareness.”

Yes, you read that correctly; even the staff at the US Embassy is suspected of committing fraud in Accra, Ghana.

According Governmental Accountability Office (GAO)[3] over 90% of family connections are requested to provide DNA evidence of their family connections. The Embassy even has a special webpage discussing “Romance Scams.” The page warns US citizens about “attempts at fraud by persons claiming to live in Ghana who profess friendship or romantic interest over the Internet.”[4]

Fraud, fraud, fraud, fraud, fraud… Did I mention fraud?

It’s around every corner, don’t you know?

And perhaps there is some fraud, but that’s not the point here.

The point is this, creating an environment that conditions immigration officers to suspect fraud around every corner significantly impacts the performance of these officers.

This is not my pet theory. This is social scientific fact. It’s called Confirmation Bias, and as Sir Francis Bacon noted above, its impact has been widely noted and accepted within social science since at least the 17th Century.

In many I-601A Provisional Waiver for Unlwaful Presence cases, USCIS has denied a Form I-601A if an applicant has any criminal history. A practice that created confusion and delay for eligible petitioners. In these cases, if the record contains evidence that an applicant was charged with an offense or convicted of any crime (other than minor traffic citations such as parking violations, red light/stop sign violations, expired license or registration, or similar offenses), regardless of the sentence imposed or whether the offense is a crime involving moral turpitude (CIMT), USCIS has denied the Form I-601A.

USCIS examined whether officers should find a reason to believe that an applicant may be subject to inadmissibility under INA section 212(a)(2)(A)(i)(I) at the time of the immigrant visa interview if it appears that the applicant’s criminal offense falls within the “petty offense” or “youthful offender” exception under INA section 212(a)(2)(A)(ii) or it appears that the applicant’s criminal offense is not a crime involving moral turpitude (CIMT) under INA section 212(a)(2)(A)(i)(I). After further consideration, USCIS issues this field guidance.

Field Guidance:

USCIS officers should review all evidence in the record, including any evidence submitted by the applicant or the attorney of record. If, based on all evidence in the record, it appears that the applicant’s criminal offense: (1) falls within the “petty offense” or “youthful offender” exception under INA section 212(a)(2)(A)(ii) at the time of the I-601A adjudication, or (2) is not a CIMT under INA section 212(a)(2)(A)(i)(I) that would render the applicant inadmissible, then USCIS officers should not find a reason to believe that the individual may be subject to inadmissibility under INA section 212(a)(2)(A)(i)(I) at the time of the immigrant visa interview solely on account of that criminal offense. The USCIS officer should continue with the adjudication to determine whether the applicant meets the other requirements for the provisional unlawful presence waiver, including whether the applicant warrants a favorable exercise of discretion.

On November 14, 2013 - after much controversy in the past years - the USCIS has finally clarified in its Policy Memorandum (PM-602-0093) that certain individuals who entered the U.S. pursuant to the Visa Waiver Program (VWP) may apply for Adjustment of Status in the United States, including those who violated their 90-day term of stay.

The Obama administration issued a new policy on November 15, 2013 that will allow immigrants in the United States illegally who are close relatives of active military troops and veterans to stay and move toward becoming permanent residents.

The administration applied the policy broadly, extending it to all active-duty members of the armed forces, to reservists including the National Guard, and to all veterans. Their spouses, children and parents will be eligible for a “parole in place,” a term that means they will be authorized to remain in the United States and many can proceed with applications for legal residency.

If an H-1B, H-2A, or H-2B petitioner submits evidence establishing that the primary reason for failing to timely file an extension of stay or change of status request was due to the government shutdown, USCIS will consider the government shutdown as an extraordinary circumstance and excuse the late filing, if the petitioner meets all other applicable requirements.

U.S. Citizenship and Immigration Services (USCIS) announces that Congress passed a bill extending the Special Immigrant Visa (SIV) program for Iraqi nationals who worked for or on behalf of the U.S. government, which the President signed into law on Oct. 4, 2013. 

This program covers Iraqi nationals who—during the period between March 20, 2003 and Sept. 30, 2013—were employed by or on behalf of the U.S. government in Iraq for a period of at least one year. It was created by section 1244 of Public Law 110-181, as amended by Public Law 110-242. The program had expired with respect to principal applicants on Sept. 30, 2013, but has now been extended. 

The extension permits USCIS to approve petitions or applications for visas or adjustment of status to lawful permanent resident in any Iraqi SIV case under section 1244 that were pending with USCIS or with the Department of State (DOS) when the program expired on Sept. 30, 2013. USCIS may also approve an additional 2,000 cases as long as the initial applications to the DOS Chief of Mission in Iraq are made by Dec. 31, 2013. 

The authority to grant derivative SIV status to spouses and children of principal Iraqi SIVs did not sunset on Sept. 30, 2013, and is not numerically capped.

Beginning September 9, 2013, USCIS will employ a new verification tool called Customer Identity Verification (CIV) in its field offices. Customers will now submit biometric data, specifically fingerprints and photographs, when appearing at USCIS offices for interviews or to receive evidence of an immigration benefit. 

After a customer arrives at a field office, clears security, and is called to the counter, USCIS will electronically scan two fingerprints and take a picture to verify their identity. The process takes just a few minutes and applies only to customers who have an interview or receive evidence of an immigration benefit. People who come to USCIS's office for InfoPass appointments or to accompany a customer will not undergo this process. After USCIS verify the customer’s identity, they can proceed to their interview or receive their document.

Currently, USCIS requires applicants and petitioners requesting immigration or naturalization benefits to visit one of our Application Support Centers (ASCs) to provide biometric data. USCIS uses this data to help determine eligibility for requested benefits. This requirement, along with providing a government-issued document for examination, will not change.
